The Defendant, David Lawrence, has appealed his conviction of driving while under the influence of an intoxicant, third offense, in violation of T.C.A. § 55-10-401. He was also convicted of violating the implied consent provision of T.C.A. § 55-10-406(a)(3) for refusing to submit to a blood-alcohol test. We granted the Defendants Rule 11 Application to decide whether the evidence is sufficient to sustain his conviction under T.C.A. § 55-10-401, which makes it unlawful to "drive or to be in physical control" of an automobile while under the influence of an intoxicant.
